These Terms & Conditions ("Terms") govern access to and use of the Optivus Retail platform (the "Platform"), operated by:

By registering for an account or using the Platform, you agree to be bound by these Terms.

If you do not agree, you must not use the Platform.

1. Scope and Eligibility

1.1 The Platform is a business-to-business (B2B) software tool intended exclusively for professional and commercial users.

1.2 By registering, you represent that:

You are at least 18 years old.

You act on behalf of a legal entity or in a professional capacity.

You are legally authorized to bind your organization.

1.3 The Platform is not intended for consumer use.

2. Description of the Platform

2.1 Optivus Retail is a digital configurator and visualization tool designed to assist users in evaluating potential compatibility between firearms, mounting solutions, optics, and accessories.

2.2 The Platform provides:

3D visualizations

Compatibility guidance

Product configuration support

2.3 The Platform is a decision-support tool. It does not provide:

Engineering certification

Gunsmithing services

Legal advice

Safety approval

Manufacturing specifications

3. Account Registration

3.1 Users may register for a free account.

3.2 You are responsible for:

Maintaining confidentiality of login credentials

All activities under your account

Ensuring account information remains accurate

3.3 Optivus Tech may suspend or terminate accounts for:

Misuse

Security risks

Non-payment

Breach of these Terms

4. Credit-Based Usage Model

4.1 The Platform operates on a credit-based system.

4.2 Credits may be:

Granted for limited free usage

Purchased via one of our Payment Providers

4.3 Credits are:

Non-transferable

Non-refundable except as required by law

Valid only within the Platform

4.4 Credits are deducted upon defined usage events (e.g., configuration generation, exports, or defined interactions).

4.5 Credit balances are maintained server-side and are authoritative.

4.6 Optivus Tech reserves the right to:

Modify credit pricing

Modify credit consumption rules

Introduce expiration periods (with notice)

5. Payments

5.1 Payments are processed by our payment provider(s).

5.2 Optivus Tech does not store full credit card numbers.

5.3 Billing records, transaction identifiers, and invoice data may be retained for accounting and compliance purposes.

5.4 Users are responsible for:

Providing accurate billing information

Paying applicable taxes (including VAT)

5.5 Failed or reversed payments may result in suspension of credit access.

6. Acceptable Use

Users agree not to:

Use the Platform for unlawful purposes

Attempt reverse engineering

Extract or scrape 3D models

Circumvent technical safeguards

Interfere with system functionality

Use automated scripts without authorization

Unauthorized activity may result in account suspension and legal action.

7. Intellectual Property

7.1 All Platform software, visualizations, processed 3D models, interfaces, and system architecture are the intellectual property of Optivus Tech.

7.2 Users are granted a limited, non-exclusive, non-transferable license to use the Platform.

7.3 Users may not:

Copy

Distribute

Reverse engineer

Commercially exploit Platform components

without written consent.

8. Compatibility and Accuracy Disclaimer

8.1 While Optivus Tech strives for accuracy, the Platform does not guarantee:

Absolute mechanical compatibility

Reflection of manufacturing tolerances

Real-time updates of product changes

Legal compliance in any jurisdiction

8.2 Compatibility results are based on available data and modeling processes.

8.3 Users remain solely responsible for:

Verifying compatibility

Ensuring safe installation

Consulting qualified professionals where necessary

9. Firearms Disclaimer

Use of the Platform in connection with firearms or related components is subject to the standalone Firearms Disclaimer, which forms an integral part of these Terms.

Users are solely responsible for compliance with all applicable laws relating to firearms, licensing, and use.

10. Service Availability

10.1 The Platform is provided on a commercially reasonable efforts basis.

10.2 Optivus Tech does not guarantee uninterrupted availability.

10.3 The Platform may be modified, updated, or suspended at any time.

11. Beta Features

11.1 The Platform may include experimental or beta features.

11.2 Such features are provided "as is" and may be modified or removed without notice.

12. Confidentiality

12.1 Each party agrees to protect confidential information disclosed in connection with use of the Platform.

12.2 Confidential information shall not be disclosed to third parties without consent.

13. Limitation of Liability

To the maximum extent permitted by law:

13.1 Optivus Tech shall not be liable for:

Indirect or consequential damages

Loss of profits

Business interruption

Regulatory penalties

Personal injury

Property damage arising from firearm use

13.2 Total liability shall not exceed the total amount paid by the user in the preceding twelve (12) months.

13.3 Use of the Platform is at the user's sole risk.

14. Indemnification

Users agree to indemnify and hold harmless Optivus Tech from claims arising from:

Misuse of the Platform

Violation of applicable laws

Improper installation or use of products

Breach of these Terms

15. Termination

15.1 Users may terminate accounts at any time.

15.2 Optivus Tech may terminate or suspend accounts for:

Breach of Terms

Security risks

Non-payment

Regulatory concerns

15.3 Unused credits are not refundable unless required by law.

16. Changes to Terms

Optivus Tech may update these Terms at any time.

Continued use of the Platform constitutes acceptance of revised Terms.

17. Governing Law

These Terms shall be governed by the laws of the Republic of Slovenia.

Disputes shall be subject to the competent courts of Slovenia.
