These Terms & Conditions ("Terms") govern access to and use of the Optivus Retail Platform (the "Platform"), operated by:

By registering for an account or using the Platform, you agree to be bound by these Terms.

If you do not agree, you must not use the Platform.

1. Scope and Eligibility

1.1 The Platform is a software tool intended for professional and commercial users, and may also be accessible to individual users depending on deployment.

1.2 By registering, you represent that:

You are at least 18 years old.

You provide accurate account information.

You are legally authorized to use the Platform where applicable.

1.3 Use of the Platform is subject to applicable law in Slovenia and your jurisdiction.

2. Description of the Platform

2.1 The Platform is a digital configurator and visualization tool designed to assist users in evaluating potential compatibility between firearms, mounting solutions, optics, and accessories.

2.2 The Platform provides:

3D visualizations

Compatibility guidance

Product configuration support

View-only configuration previews

2.3 The Platform is a decision-support tool. It does not provide:

Engineering certification

Gunsmithing services

Legal advice

Safety approval

Manufacturing specifications

3. Account Registration

3.1 Users may register for an account where registration is enabled.

3.2 You are responsible for:

Maintaining confidentiality of login credentials

All activities under your account

Ensuring account information remains accurate

3.3 Optivus Tech d.o.o. may suspend or terminate accounts for misuse, security risks, non-payment, or breach of these Terms.

4. Credit-Based Usage Model (If Enabled)

4.1 The Platform may operate on a credit-based system.

4.2 Credits may be granted for limited free usage or purchased via payment providers.

4.3 Credits are non-transferable, non-refundable except as required by law, and valid only within the Platform.

4.4 Credits are deducted upon defined usage events (e.g., configuration generation, exports, or defined interactions).

4.5 Credit balances are maintained server-side and are authoritative.

4.6 Optivus Tech d.o.o. reserves the right to modify credit pricing, consumption rules, or introduce expiration periods (with notice).

5. Payments (If Applicable)

5.1 Payments are processed by independent payment provider(s).

5.2 Optivus Tech d.o.o. does not store full credit card numbers.

5.3 Billing records, transaction identifiers, and invoice data may be retained for accounting and compliance purposes.

5.4 Users are responsible for providing accurate billing information and paying applicable taxes.

5.5 Failed or reversed payments may result in suspension of credit access.

6. Configuration Previews

6.1 The Platform may allow users to create view-only configuration previews (preview links).

6.2 Preview links may be public or accessible to anyone with the link unless otherwise stated.

6.3 Do not include confidential or personal information in configuration names or preview metadata.

7. Acceptable Use

Users agree not to:

Use the Platform for unlawful purposes

Attempt reverse engineering

Extract or scrape 3D models

Circumvent technical safeguards

Interfere with system functionality

Use automated scripts without authorization

Provide false account, country, eligibility, or consent information

Unauthorized activity may result in account suspension and legal action.

8. Intellectual Property

8.1 All Platform software, visualizations, processed 3D models, interfaces, and system architecture are the intellectual property of Optivus Tech d.o.o. and/or its licensors.

8.2 Users are granted a limited, non-exclusive, non-transferable license to use the Platform.

8.3 Users may not copy, distribute, reverse engineer, or commercially exploit Platform components without written consent.

9. Compatibility and Accuracy Disclaimer

9.1 While Optivus Tech d.o.o. strives for accuracy, the Platform does not guarantee absolute mechanical compatibility, reflection of manufacturing tolerances, real-time updates of product changes, or legal compliance in any jurisdiction.

9.2 Compatibility results are based on available data and modeling processes.

9.3 Users remain solely responsible for verifying compatibility, ensuring safe installation, and consulting qualified professionals where necessary.

10. Firearms Disclaimer

Use of the Platform in connection with firearms or related components is subject to the standalone Firearms Disclaimer, which forms an integral part of these Terms.

Users are solely responsible for compliance with all applicable laws relating to firearms, licensing, and use.

11. Service Availability

11.1 The Platform is provided on a commercially reasonable efforts basis.

11.2 Optivus Tech d.o.o. does not guarantee uninterrupted availability.

11.3 The Platform may be modified, updated, or suspended at any time.

12. Beta Features

The Platform may include experimental or beta features provided "as is" and may be modified or removed without notice.

13. Limitation of Liability

To the maximum extent permitted by law:

13.1 Optivus Tech d.o.o. shall not be liable for indirect or consequential damages, loss of profits, business interruption, regulatory penalties, personal injury, or property damage arising from firearm use.

13.2 Total liability may be limited to the total amount paid by the user in the preceding twelve (12) months where applicable.

13.3 Use of the Platform is at the user's sole risk.

Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.

14. Termination

14.1 Users may terminate accounts at any time.

14.2 Optivus Tech d.o.o. may terminate or suspend accounts for breach of Terms, security risks, non-payment, or regulatory concerns.

14.3 Unused credits are not refundable unless required by law.

15. Changes to Terms

Optivus Tech d.o.o. may update these Terms at any time. The updated version will show a new "Last Updated" date. Where required, users may be asked to review and accept updated Terms before continuing.

16. Governing Law

These Terms shall be governed by the laws of Slovenia.

Disputes shall be subject to the competent courts of Slovenia, unless mandatory consumer protection laws specify otherwise.
